FMCSA renews 30 minute rest break exemption for OS/OW carriers

The FMCSA has renewed SC&RA’s exemption from the federal Hours of Service (HOW) 30-minute rest break rule for oversize/overweight commercial vehicles operating under travel permits.
The Specialized Carriers and Rigging Association, SC&RA, received confirmation that the Federal Motor Carrier Safety Administration (FMCSA) has issued a provisional 6-month renewal of SC&RA’s exemption from the federal Hours of Service (HOS) 30-minute rest break rule for oversize/overweight commercial motor vehicles operating under state and/or local special travel permits. The provisional exemption is effective from June 17 to December 17, 2025. Carriers wishing to take advantage of this exemption should keep a copy of the appropriate documentation on board all moves, and should remove the prior exemption which expired June 18, 2025.
FMCSA is currently seeking public comment on the exemption for consideration of a full 5-year term. Members are strongly encouraged to submit comments to the Federal Register supportive of a full 5-year renewal, and may do so online until July 21, 2025. Once FMCSA issues a final approval of a 5-year exemption, SC&RA will provide the documentation to replace the provisional exemption currently in force.
